After the district court ruled in favor of the secretary of state and issued a TRO, opponents of the state’s 2025 gerrymandered congressional map sought an emergency stay at the Eighth Circuit. The Eighth Circuit declined, writing that “we either lack jurisdiction over the appeal or, based on the briefing we have so far, the stay factors have not been met.”
Opponents immediately sought a stay at the Supreme Court, going again to Justice Kavanaugh. The Court ordered responses by 10 a.m. on Thursday.
